Rule 14-403. Establishmentand membership of Board.

(a) Establishment. There isestablished by this Court a Board of Mandatory Continuing Legal Education. TheBoard comprises 15 members, at least 13 of whom are lawyers admitted to theBar, and up to 2 of whom may be paralegal practitioners.

(b) Terms. Members areappointed for staggered four-year terms. No lawyer or paralegal practitionermay serve more than two consecutive terms as a member of the Board unlessappointed by the Supreme Court as the Board chair or when justified by specialcircumstances, as determined by the Supreme Court. The Board may also have upto two nonvoting emeritus members. An emeritus member has the same authorityand duties as other Board members, except that the member does not haveauthority to vote. An emeritus member may serve two terms in addition to theterms served as a member.

(c) Application andrecruitment of committee members. Vacancies on the Board shall be announced ina manner reasonably calculated to reach members of the Utah State Bar. Thenotice shall specify a brief description of the Board?s responsibilities, themethod for submitting an application or letter of interest, and the applicationdeadline. Members of the Board or the Supreme Court may solicit applicationsfor membership on the Board. Applications and letters of interest shall besubmitted to the Supreme Court.

(d) Appointment of committeemembers and chair. Upon expiration of the application deadline, the SupremeCourt shall review the applications and letters of interest and appoint thoseindividuals who are best suited to serve on the Board. In the event of amid-term vacancy the Supreme Court shall appoint a new member to serve for theremainder of the term. The Supreme Court shall select a chair from among theBoard?s members.

(e) Absences. In the event aBoard member fails to attend three Board meetings during a calendar year, thechair may notify the Supreme Court of those absences and may request that theSupreme Court replace that Board member.

(f) Administrativeassistance. The MCLE Director will support the Board.
